Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that the employer
failed to make necessary repairs to the hoists in its facility, thereby
resulting in the operation of
the hoists with defective or missing parts affecting the safe operation of
the hoists and likely to
result in serious injury or death to employees in the event of hoist
malfunction or failure:
(a) Machine Shop, Yale Hoist; On or before Friday, June 29, 2010,
employees were exposed
to struck-by hazards due falling parts when the hoist's upper limit switch
was non-existent.
(b) Machine Shop, Yale Hoist; On or before Friday, June 29, 2010,
employees were exposed
to struck-by hazards by overloading the hoist due to the absence of
capacity information.
(c) Machine Shop, Yale Hoist; On or before Friday, June 29, 2010,
employees were exposed
to struck-by hazards due to hook failure when the hook had been stretched
one-half inch beyond
its original shape.
(d) Machine Shop, Robbins and Myers 2 Ton Hoist; On or before Friday, June
29, 2010,
employees were exposed to struck-by hazards due to a defective hook
retention latch.
One feasible and useful method to correct the hazard is to ensure a
preventive hoist maintenance
program is in place and defects are promptly and properly abated in
accordance with ASME
B30.16, Overhead Hoists, Chapter 16-1 "Marking, Construction, and
Installation" Chapter 16-2,
"Inspection, Testing, and Maintenance" and Chapter 16-3, "Operation".
