Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) In the baler building a Nissan forklift was not equipped with a seatbelt exposing the operator to a crushing and entrapment hazard as observed on or about September 23, 2010. b) In the rebar cutting area a TCM model FCG25 forklift was not equipped with a functioning seatbelt exposing the operator to a crushing and entrapment hazard as observed on or about September 23, 2010. c) Outside the fabrication shop the seat belt on a Yale forklift was not accessible and used to protect the operator from a crushing and entrapment hazard as observed on or about September 23, 2010. ABATEMENT CERTIFICATION REQUIRED ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to: a) Follow the manufacturer's instructions in the operator's manual to always use the seatbelt. b) Follow the safety standard published on page 10, section 5.3.19 of ANSI/ ITSDF B56.1-2005 Safety Standards for Low Lift and High Lift Trucks which states that "an active operator protective device or system, when provided, shall be used". c) Instruct each operator of the requirement to always use the seatbelt when operating a forklift.
