Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an amputation hazard from the unintentional operation of a
press brake:
a) In the shop area, the foot pedal (treadle) on a Roto-Die hydraulic
press brake was unguarded
exposing the operator and others to an amputation hazard from
unintentional operation as
observed on or about March 18, 2011.
Among other methods, one feasible and acceptable method to abate this is
to follow the safety
standard: Ansi B11.2-1995, Hydraulic Power Presses, Section 6.3.9,
Paragraph 4 and/or Ansi
B11.3-2002, Section 6.10.3, Safety Requirements For Power Press Brakes.
ABATEMENT CERTIFICATION REQUIRED
In the alternative:
29 CFR 1910.212(a)(1): One or more methods of machine guarding were not
provided to protect
the operator and other employees in the machine area from hazards such as
those created by
point of operation, ingoing nip points, rotating parts, flying chips and
sparks:
a) In the shop area, the unguarded foot pedal (treadle) on a Roto-Die
hydraulic press brake
exposed workers to an amputation hazard in the event of unintentional
operation as observed on
or about March 18, 2011.
ABATEMENT CERTIFICATION REQUIREDATION
