Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being pinned and crushed:
a) In the shop area: The Nissan model 90 forklift was allowed to be used
without a seat belt,
exposing the operator to the hazard of being pinned and crushed by the
overhead guard in the
event of a rollover accident, observed on or about March 25, 2011.
ABATEMENT CERTIFICATION REQUIRED
ABATEMENT NOTE:
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to:
a) Follow the manufacturer's instructions in the operator's manual for use
of the seatbelt.
b) Follow the safety standards published on page 10, section 5.3.19 of
ANSI/ITSDF B56.1-2005
Safety Standards for Low Lift and High Lift Trucks which states that "an
active operator
protective device when provided, shall be used".
c) Instruct each operator of the requirements to always use the seatbelt
when operating a forklift.
