Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being severely burned by hot asphalt. a) On May 11, 2011, a truck driver was severely injured while offloading asphalt from a 7000 gallon capacity tank truck to storage tanks. During the offloading process, a Betts valve ruptured and sprayed hot asphalt on the driver. The employer did not provide a pressure relief valve as required by Section 7.5.3 of the American Petroleum Institute Standard 676 Positive Displacement Pumps - Rotary. The employer did not provide pressure gages/sensors next to the pump suction and discharge connections to monitor pressures as required by the pump manufacturer. Observed on or about May 16, 2011. Among others, one feasible and acceptable abatement method to correct this hazard is to install a pressure relief valve compliant with API Standard 676 and to install pressure gages/sensor next to the pump suction and discharge connections to monitor pressures in compliance with the manufacturers Safety Instructions. Pursuant to 29 CFR 1903.19(d), the employer must provide documentation and certification to OSHA that this violation has been abated within 10 calendar days of the "Date by which Violation Must be Abated". ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
