North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to struck by and caught
in-between hazards:
a) within the garage area, the employer did not establish a periodic
inspection
procedure for the BendPak and ALM automotive lifts to ensure reliability
and
safe operation when raising and supporting vehicles during maintenance and
repair operations.
b) within the garage area, the employer did not document operator training
that
ensures operators of automotive lifts were instructed in the safe use and
operation
of the lift.

Among other methods, one feasible and acceptable method to abate this
hazard
is to ensure qualified individuals perform repairs to the automotive lifts
