Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to the hazards of falling:
125 Old Gate Lane, Milford CT: The employer did not ensure through
providing appropriate
equipment and methods that the employees, required to perform a task,
"checking and reading"
the serial numbers from the intermodal containers that stored in tiers,
were performing the
"task" safely at all times. The employees could not perform the "task"
from the floor level.
On or about March 26, 2010, an employee fell approximately 15 feet to the
floor while
"shimmying up" between the containers to perform the "task".  The employee
sustained serious
injuries from the incident.
Among other methods, one feasible and acceptable abatement method is to:
1. Utilize portable ladders, steps and equivalent.
2. Utilize other engineering technology, such as Radio Frequency
Identification Tags (RFID).
3. Utilize other container storage methods.
4. Train and instruct employees.
5. Utilize other effective and safe methods.
