Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught between, stuck by, and fall hazards while riding in the bucket of an excavator: a) Employees were riding in the bucket of an excavator above a trench that was approximately 14 feet in depth. Among others, feasible and acceptable methods of abatement would be to never allow employees to enter the bucket of an excavator or any other similar equipment as described in the Operator's Manual, and the Equipment Manufacturers Institute Safety Manual for Hydraulic Excavators. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the certification of corrective action worksheet).
