Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about April 6, 2010, on State Highway 300 East, at least one employee was exposed to struck-by hazards while crossing the five-lane highway during highway litter pickup. Among other methods, feasible means of abatement include but is not limited to: 1. Minimize roadway crossings; 2. Supervisors will escort consumers anytime a roadway must be crossed; 3. Ensure that road crossings occur only in locations with clear visibility (not at bends, inclines, etc.); and 4. Ensure that supervisors maintain radio communication with at least one consumer working on the opposite side of five (5) lane roadways;"
