Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to struck-by and caught-between hazards:
On or about April 19, 2010, and at times prior thereto, employees making
deliveries were
exposed to being struck-by and caught-between a tractor/trailer and the
loading dock.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE MEANS TO
ABATE THE HAZARD INCLUDES, BUT IS NOT LIMITED TO: (1) Use wheel chocks to
prevent rolling; (2) Set both the tractor and trailer brakes; (3) Use the
EZ-Roll dock
attachment to position the portable dock plate in the correct position;
(4) Ensure that trailers
delivering product to stores with manual dock plates are loaded to
capacity that will allow for
the safe placement of the manual dock plates.
