Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and crushing hazards: On or about July 8, 2010 and times prior thereto, at a workplace located at 5351 Catron, Dallas, Texas; at least four (4) employees were installing steel beams while working from a work platform that was attached to a Sky Track rough terrain lift truck. The employees were transported from the east side of the building to the center of the building. The employees were exposed to falling and being struck and/or crushed-by the moving lift truck. Among other methods, at least two feasible means of abatement include but not limited to: (1) Comply with the manufacturer's safety warning displayed on the equipment. "WARNING CARRYING PERSONNEL can result in death or serious injury. Only Lift or Lower personnel when using a work platform. Never move machine with personnel on the work platform." and/or; (2) Provide and utilize approved scissor lift/mobile scaffolding according to manufactures instructions.
