Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
to each of his employees employment and a place of employment which were
free from
recognized hazards such as fire, deflagration and explosion that were
causing or likely to cause
death or serious physical harm to employees:
On or about November 4, 2010, and at times prior thereto, the employer, by
not preventing or
suppressing the escape of explosive dust into work areas from equipment
which included but
were not limited to the following, exposed employees to fire, deflagration
and explosion hazards.
a)Receiving leg of the alfalfa mill at the boot;
b)Hayes & Stolz rotary scalper - cleaner located on the mezzanine level in
blending
under mixer surge approximately 10-ft above grade floor;
c)14-in x 14-ft OAL Essmueller drag conveyor (model RB14 x 17' 01/4" CTRS
(19' OAL) located under the rotary scalper mezzanine in blending
approximately
9-ft above floor grade;
d)Air assist plenum chamber and direct feeding screw conveyor underneath
the
post-grind #2 hammermill in blending;
e)CPM-Roskamp (Champion), Mfg, hammermills (pre-grind #1 and post-grind #2)
located on the upper mezzanine in blending at the grinder floor level;
f)Main batch, 3-ton mixer located on the mezzanine level in blending at
the 22-ft
enclosed headhouse;
g)Fine powder shaker located in the "fat plant" just North of the Wenger
Mfg. Co.
extruder-dryer-cooler.
Among other feasible abatement methods to correct the hazard listed in
instances (a) through (g)
above, one method is to implement the requirements listed in Sections 10.1
and 10.3 of NFPA
61, Standard for the Prevention of Fire and Dust Explosions in
Agricultural
and Food Processing
Facilities, 2008 Edition, to prevent or suppress the emissions of
combustible dust from process
and conveying equipment or material transfer points into the work area(s).
h)Post-grind extruder feed screw conveyor (12-in x 24-ft OAL) located on
the upper
grinding mezzanine in blending approximately 8-feet above the floor; and
In addition to the abatement method listed above for instance (a) through
(g), a feasible method
to correct the hazard listed in instance (h) is to comply with Paragraph
7.3.3 of NFPA 61
Standard for the Prevention of Fire and Dust Explosions in Agricultural
and Food Processing
Facilities, 2008 Edition, which requires screw, drag or en-masse conveyors
to be fully enclosed
in metal housing and designed to either relieve or stop if the discharge
end becomes plugged.
