Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards:
On or about September 22, 2010, and at times prior thereto, on the South
side of the Davis
Building located at 1309 Main Street, Dallas, TX; at least two employees,
who were washing
windows while working from Sky Genie Seatboard Systems without vertical
life lines
attached to anchor points independent of the seatboard systems, were
exposed to the hazard
of falling as much as 252 feet to the lower level.
Among other methods, feasible and acceptable means of abatement include
but are not
limited to: (1) Install roof support equipment and suspension devices for
rope descent
systems that meet the design and installation requirements of American
National
Standards
Institute standard ANSI/IWCA I-14.1 "Window Cleaning Safety;"
(2)Ensure that fall arrest system including vertical lines are independent
of scaffold or
suspension device support lines.
(3)Ensure that independent anchorage points have been certified that they
are capable of
sustaining a 5000 pound minimum load, or a minimum 4 to 1 safety factor
whichever
is larger.
