Section 5a(1) of the Occupational Safety and Health Act of 1970:  The
employer does not
furnish employment and a place of employment which were free from
recognized hazards of
carrying objects while using portable ladders that may cause them to lose
their balance and
fall causing or likely to cause death or serious physical harm to
employees:
The employer does not ensure employees do not carry objects that can cause
them to lose
their balance while using portable ladders.  This violation most recently
occurred on or about
Oct 5, 2010, at the work site located at Bldg #12, Digester #3, 10011 Log
Cabin Rd.,
Dallas, TX, where an employee carried a fuel-gas torch to cut bolts and
remove water pipes
while working from the top of a portable extension ladder.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to ensure that employees do not carry and use tools while working from
the upper rungs of
portable ladders, as referenced in ANSI A14.5  -1974 section A3.6
Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days, the employer
must submit
documentation describing the actions it is taking to establish,
communicate, and implement
written procedures to ensure that employees are trained and understand
they are not to carry
objects or loads while using a portable ladder.
Or in the alternative:
29 CFR 1926.1053(b)(22):  Employees using ladders were carrying objects or
loads that
could cause them to lose their balance and fall:
The employer does not ensure employees do not carry objects that can cause
them to lose
their balance while using portable ladders.  This violation most recently
occurred on or about
Oct 5, 2010, at the work site located at Bldg #12, Digester #3, 10011 Log
Cabin Rd.,
Dallas, TX, where an employee carried a fuel-gas torch to cut bolts and

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days, the employer
