Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or crushed by hazards: On or about April 1, 2011, and at times prior thereto, employees while emptying refuse and waste containers into rear loader garbage trucks were exposed to struck-by and/or crushed-by hazards. Among other methods, feasible means of abatement include but are not limited to, implementing and enforcing employees' compliance with the McNeilus rear loader operating manual regarding securing container latches. Also, implementing and enforcing work rules to prevent employees from reaching into machines while the packer/compactor is cycling.
