Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from recognized hazards of being struck by moving motorized vehicles which are causing or likely to cause death or serious physical harm to employees: This violation occurred on July 27 and times thereafter, in the protein processing plant in Mount Pleasant, TX., where the employer did not ensure that adequate separation was maintained between employees and spotter tractor trailers in the poultry by-products dock area. Among other methods, feasible and acceptable methods to correct this hazard include, but are not limited to: 1) Perform a job hazard analysis for tasks performed in the protein dock area where trailers are backed 150 feet inside the building. Such analysis should include frequency of assigned tasks, visual and auditory warnings, and pedestrian walkways; 2) The use of a traffic control monitor to direct spotter drivers while backing into the dock area. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days, the employer must submit documentation describing the actions it is taking to protect workers from being struck by motorized vehicles in the protein dock area.
