Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment w hich are free from recognized hazards that are causing or are likely to cause de ath or serious physical harm to employees in that employees are exposed to fire, deflagration, and explosion hazards: This violation occurred at a workplace loc ated at 584 U.S. Highway 84 East, Mount Enterprise, TX 75681, where the employer used a wood burning stove in the supply mill work area where class III combusti ble dust had accumulated on the floors, equipment, walls and ledges. The employe r's workplace did not have a dust collection system. Among other feasible means of abatement would be to comply with NFPA 654, Standard for the Prevention of Fi re and Dust Explosions from the Manufacturing, Processing, and Handling of Combu stible Particulate Solids. NFPA 654, Paragraph 9.6 details requirements for "Process an d Comfort Heating Systems." Pursuant to 29 C.F.R. 1903.19, within ten (10) calen dar days of the abatment date, the employer must submit documentation showing th at it follows guidance in NFPA 654, Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Part iculate Solids, including describing the steps that it is taking to ensure that it does not use a wood burning stove in a class III combustible dust environment .
