29 Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or crushed-by hazards: On October 11, 2011, and at times prior thereto, employees were exposed to struck by and/or crushed-by hazards while operating Nissan forklift trucks without seat belts. One feasible method to correct the hazard includes, but is not limited to: install a seat belt on the forklift and enforce the use of seat belts while operating the forklift.
