Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Mt Kemble Ave, Morristown, NJ. Employees installing cable alongside and across an active roadway were not visible to passing motorists. Thereby exposing them to being struck by motor vehicles. Violation occurred on or about 03/23/2010 One feasible and acceptable abatement method, among others, is to provide, and require, employees with hi-visibility vests to be worn when working near or on active roadways.
