North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by bullets and fragments during firearm testing: a)indoor firing range, while conducting test firing of handguns (particularly customer returns) employees were exposed to ricocheting bullets, fragments, and back splatter. The design of the existing backstop, bullet trap, and rubber curtains did not capture all the bullets and occasionally the bullets and fragments traveled back in the range, toward the shooter. b)indoor firing range, steel baffles installed around lighting fixtures did not contain soft wood to prevent ricochets and black splatter. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is to: 1-Modify or replace the existing back stop and bullet trap with a designed/engineered system to decelerate the bullet, minimize disintegration, and capture the bullets and fragments. 2-Cover baffles with soft wood. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by bullets and being shot from an accidental discharge of a firearm: a)throughout the facility, the employer did not utilize procedures or other methods to prevent loaded handguns from leaving the indoor firing range. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is to: 1-Develop and enforce range safety procedures which requires the insertion of a chamber safety flag or device and/or other procedures to verify that the handgun chamber is clear/unloaded prior to leaving the indoor firing range.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and explosion: a)finishing/polishing area, Kraemer KTM S 52-12 CYN 5hp enclosureless dry-type dust collector utilized for combustible metal dust was located inside the building. b)finishing/polishing area, ducts from machines emitting combustible metal dusts were not fabricated and assembled with a smooth interior surface. c)finishing/polishing area, Kraemer KTM S 52-12 CYN 5hp enclosureless dry-type dust collector utilized for combustible metal dust; metal drum used to collect the dust was not bonded and grounded. d)finishing/polishing area, the building and area containing combustible metal dust was not designed and constructed with explosion venting. e)finishing/polishing area, the employer did not develop a program to control and minimize hazards associated with combustible metal dust, such as, but not limited to: fire and explosion protection and prevention, dust control equipment, housekeeping, control of ignition sources, control of combustible materials, emergency response, emergency preparedness, operating and maintenance procedures. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is to comply with the National Fire Protection Agency (NFPA) 484, "Standard for Combustible Metals" (2009). Additional abatement methods include, but not limited to: 1-Relocate dust collector outside the building. 2-Utilize a conductive duct with a smooth interior surface. 3-Bond and ground the metal drum to the dust collector. 4-Install pressure relief system so that deflagration venting is to a safe location outside the building. 5-Develop procedures to include an inspection, testing, and maintenance program to control and minimize the hazards associated with combustible metal dusts.
