Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to fire and explosion hazards:
a)facility, Building #2, Brewer Golden Eagle 4-head bandsaw, the flexible
local exhaust duct
attached to the bandsaw was damaged with holes and not maintained in such
a manner to control
the escape of fugitive dust during normal operation.
b)facility, Building #2 and Building #3, ductwork used to pneumatically
convey wood dust from
the Brewer Golden Eagle 4-head bandsaw and the Brewer Golden Eagle 2-head
band saw to the
outside dust collector were constructed of nonconductive PVC.
c)facility, Building #2, Brewer Golden Eagle 4-head bandsaw, the flexible
local exhaust duct
exceeded the length necessary for effective connection to machine.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
install appropriate dust control by removing all PVC pipes and using only
metallic duct work
which is conductive and to install new flexible duct in a length not
exceeding the minimum
required for machine operation accordance with National Fire Protection
Association (NFPA)
664, Standard for the Prevention of fires and Explosions in Wood
Processing and Woodworking
Facilities (2007), paragraphs 8.2.2.2.11, 8.2.2.2.1.2, 11.1.6..1.2,
