Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard from steel storage racks not being anchored to the floor. On or about 9/1/10, in the outdoor lumber yard, employees were exposed to a struck by hazard from improper installation of metal storage racking systems. The employees were instructed to place and retrieve lumber and other building material from the racks as needed. Uprights were not anchored to the floor as required by the racking system manufacturer and cantilever arms and welds were cracked thoughout the racking system. Among other methods, one feasible and acceptable method to correct this hazard is to follow the Sunbeltrack assembly instructions and the ANSI standard MH16.1-2008. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRETIVE ACTION WORKSHEET).
