Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: the hazard being struck-by the bucket of the excavator:
On or about December 19, 2010 at the 7200 block of Industrial Highway and
Walden Road
Macon, Georgia 31216, the employer failed to provide the employees
operating and working
near the bucket of a Hyundai 210LC -7 excavator a Hyundai manufactured
authorized bucket
attachment while lifting large concrete slabs.
Among other methods, one feasible and acceptable means of abatement
include, but not limited,
to: Comply with the follow manual precaution:
Hydraulic Excavator Operator's Manual Rolex Model 210 LC-7 indicates the
following
procedures: Section: Before Operating the Machine (Excavator):
a. Page 1-4 - PRECAUTION FOR ATTACHMENTS: Do not use attachments that are
not
authorized by Hyundai or your Hyundai distributor. Use of unauthorized
attachments could
create a safety problem and adversely affect the proper operation and
useful life or the machine.
Any injuries, accidents, product failures resulting from the use of
unauthorized attachments are
not the responsibility of Hyundai.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
