Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: Struck-by hazards associated with the use of heavy
equipment to move scrap
metal within a recycling facility.
On or about 12/21/10 at Jackson, GA: Employees were exposed to struck by
hazards, while
operating an Liebherr Excavator and Prentice Knuckleboom Loader in a scrap
metal
recycling
facility. The employer failed to protect equipment operators from metal
debris by furnishing cabs
with protective windshields or other protective systems.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THESE HAZARDS IS:
Heavy equipment operator cabs are designed with windshields or other
systems, which are
designed to protect the operators from hazards, which may encroach the
operator's cab and
cause injury.  The employer shall install protective systems in the
operator's cabs on their
excavator and knuckleboom, in order to protect the operators from debris
resulting from scrap
metal recycling operation.
