Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Dermatitis, Inhalation injuries/illnesses and burns, when the employer failed to protect the 1000 gallon diesel fuel tank from vehicular damage. On or about March 25, 2011, at the Southern Sanitation yard in Loganville, Georgia: Employees use a 1000 gallon diesel fuel tank to dispense fuel into the garbage trucks. Employees were exposed to burn hazards from vehicles operating in the vicinity of and backing up to the diesel fuel tank. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS: As specified in NFPA30, Section 4.3.2.7, the employer may place bollards around the 1000 gallon diesel fuel tank to protect the tank from damage by vehicle contact. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
