21 VSA Title 23, Chapter 3, Sub-Chapter 5, Section 223(a): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed crushing hazards associated to fork lift tip-overs. Location: Price Chopper Supermarket, rear of building, Ames Shopping Plaza, Barre-Montpelier Road, Berlin Violation: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed crushing hazards associated to fork lift tip-overs in that the employer did not ensure that the fork lift operator who received operator training by the employer wear the provided equipped seat belt while operating and driving the Toyota Powered Industrial Fork Lift Truck model 7FGCU25. An example of a feasible and acceptable means of abatement include but is not limited to is an inspection process to ensure that powered industrial truck operators understand the training given by the employer that would follow up on the employees understanding of requirements and training content. Another means of abatement is to facilitate more frequent updates such as tool box chats or safety minute chats about the safe practices on operating a powered industrial trucks and to actually inspect employees to ensure that all safety systems including seat belts are used.
