29CFR 1910.268(j)(1)(ii) : The employer shall ensure that tests shall be made at the beginning of each shift by a competant person to ensure the vehicle brakes and operating systems are in proper working condition. or in the alternative: 21 VSA Title 23, Chapter 3, Sub-Chapter 5, Section 223(a) : Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards associated with damaged and defective motor vehicle equipment, uninspected motor vehicle equipment, while operating the company fleet of vehicles consisting of but not limited to large and mid size pick-up trucks and vans. Location : Vehicles based from employee residences as well as from 57 Commerce Ave, South Burlington VT Violation: The employer did not provide a work place free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to the hazards of damaged and defective equipment such as cracked and broken windshields, cracked and broken mirrors, tires that leak air pressure and need filling daily, vehicles that have not passed a state inspection in the past 12 months, vehicles not tested at the beginning of each shift to ensure the vehicles brakes and operating systems are in proper working condition.( Pretrip Inspection ) Abatement methods: Train employees to perform a pretrip inspection at the start of each day, Implement procedures for immediate repair of safety related items, Annual state inspections,
