21 VSA Title 23, Chapter 3, Sub-chapter5, Section 223 (a)(1) Of
the Occupational Safety and Health Act of 1970: The employer did
not furnish employment and a place of employment which were free
from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that they were
exposed to demolition dust containing hazardous chemicals.
Feasible and resonable means of abatement is to: 1) complete a
hazard assessment of the work place to determine what hazards are
present. 2) make sure contractor was taking the steps necessary
to safeguard the health and safety of employees. 3) no employees
allowed in area where demolition operations are being performed
and could adversely effect employees health,(ANZI Standard
Ref.A10-6).4) suppress and minimize dust with wetting agents or
sweeping compounds, long established in the demolition industry.
Utilize efficient and effective dust collecting methods. Locate
pollutant sources as far away as possible from supply ducts and
areas occupied by workers. Supply and exhaust systems may have to
be shut down or isolated during activity. Pressure differentials
utilized to prevent contaminated air from entering clean areas.
LOCATION: Thayer Building, North Street, Burlington
VIOLATION:  On April 1, 2011, CSHO noted the employer did not
take necessary precautions to prevent the exposure of employees
to hazardous dust from the demolition of a building adjacent to
employees work area. The work area was located within a
construction zone.
