of the Occupational Safety and Health
Act of 1970:  The employer did not furnish employment and a place of
employment which were free from
recognized hazards that were causing or likely to cause death or serious
physical
harm to employees in that
employees were exposed to hazards associated with operating a articulating
aerial bucket truck equipped with
defective and worn suspension springs.

Violation: The employer did not furnish employment and a place of
employment which were free from recognized
hazards that were causing or likely to cause death or serious physical
harm to employees in that employees were
exposed to the hazards while operating a boom truck, using the aerial lift
boom, equipped with worn and defective
rear springs, a defective boom rest, and an inoperative device that lowers
the boom in the event of an emergency.
A feasible and useful method to correct the hazard. The most feasible and
useful method to abate this hazard is
to remove the truck from service therefore eliminating the hazard for
employees until the time arrived to repair
the deficiency. Since the truck had defective rear springs, the truck
could not be operated.
