Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing: a) On May 25,2010, in ACME Market Store # 7792 receiving area, there was no maintenance plan in place for the Vertical Marathon Baler used by employees from multiple departments throughout the store. The store was not able to produce a copy of the plan which outlines proper operations and maintenance of the Marathon Baler. ACCEPTABLE ABATEMENT METHODS TO CORRECT AND/OR PREVENT HAZARDS: a) Implement a maintenance program for the baler in accordance with ANSI Z245.2-1992 Section 6.1(e) and the manufacturer's instruction manual. ABATEMENT DOCUMENTATION REQUIRED
