Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to severe burn injuries from the
potential dust explosion that could have resulted from, or have been
exacerbated by, a lack of a backflash
damper and the lack of deflagration vents for the dust collector:
(a)Gichner Systems Group, Incorporated - The dust collection system and
the ductwork leading to
the dust collector were not protected by a deflagration vent and a back
flash damper in the
event of a fire or explosion, on or about April 13, 2010.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method to
correct this hazard includes following the National Fire Protection
Association (NFPA) 664, Standard
for the Prevention of Fires and Explosions in Wood Processing and
Woodworking Facilities, 2007
Edition, including, but not limited to installing a back flash damper, a
deflagration system or a
suppression system on the dust collector and/or ductwork.
