Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck by hazards: a) Employees were exposed to the hazard of falling approximately 10 feet while working from bucket attachments on Gehl and Kamatsu Compact Track Loaders. b) Employees were exposed to the hazard of falling approximately 10 feet while using the bucket attachments on Gehl and Komatsu Compact Track Loaders for roof access and egress. Among others, feasible and acceptable means of abatement would include, not allowing employees to enter and work from the buckets of Compact Track Loaders or similar equipment as described in the manufacturer's warnings, and provide ladders to access upper levels of the structure during construction. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the certification of corrective action worksheet).
