Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling or being crushed: On or about May 12, 2010, at 350 Lincoln Road in Miami, FL two employees were using the forks of a powered industrial truck to descend from a 9 feet wooden balcony platform exposing the employees to the hazard of a fall or being crushed. Among other methods of abatement, one feasible and acceptable method to correct the hazard is to follow the forklift operator's manual which states in writing "DO NOT permit riders on the forks or pallet" and "Use only specialized equipment designed to safely raise personnel to high work areas!"; furthermore, the equipment has a label located on the left side of the mast indicating not to climb on the forks. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
