Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.At the stringpiece area, a means of fall protection was not provided for an employee who worked on top of intermodal containers while unsecuring sling's hooks from container's corner castings, exposing the employee to a fall hazard of 8'-0", on or about 5/13/2010. Among other methods, feasible and acceptable means to correct the hazard is to prohibit employees from conducting work on top of intermodal containers without the use of a fall protection system or unsecure sling's hooks from ground level.
