Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: On or about 07/20/2010 on a job site located on Sandpiper/Okeechobee Blvd, West Palm Beach, an employee was exposed to a fall hazard as he worked from the top step of a metal portable ladder to perform landscaping work. Among other methods of abatement, one feasible and acceptable method to correct the hazard is to prohibit employees from standing on the top step of a portable ladder to perform their job.
