Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by collapsing storage racks. On or about April 14, 2010, the storage rack systems used to store various mechanical components were not installed so as to prevent damage or collapse of the racks. Deficiencies included anchoring of columns and use of permanent plaques placed in the environs of the existing racks, designating maximum load capacities. Among other methods, one feasible and acceptable method of abatement is to provide anchors that are capable of resisting sheer forces caused by horizontal and vertical loads and use of clearly visible plaques indicating maximum loading capacities as designated by the manufacturer or qualified person.
