Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by the collapsing boom pump due to failure to
conduct
recommended maintenance
This violation was last known to occur on 6/24/10. Employees and
subcontractor' employees
were exposed to the boom of the Schwing America pump collapsing on them
because proper
maintenance checks are not performed.
Among other methods, one feasible and acceptable method to abate this
hazard is to make a
visual inspection of the structural support system on a daily to monthly
basis by a designated
person in accordance with manufacturer's recommendation in the operator's
manual.
Pursuant to 29 CFR 1903.19, the employer must submit an abatement plan
within 25 days
describing the actions it is taking to ensure compliance, including a
description of how these
steps protect employees from being struck by collapsing boom pumps.sing
