Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards posed by inadequate press brake operation procedures: On or about July 1, 2010, the employer had not developed and implemented procedures to ensure employees performing press brake operations, including loading and unloading of workpiece components demonstrated safe working procedures. Employees are exposed to amputation hazards. Among other methods, one feasible and acceptable method to correct this hazard, according to ANSI B11.3-1982, includes but is not limited to developing and implementing a training program for press brake operators. The program should include procedures to ensure employees are aware of the hazards of placing any body member within the point of operation.
