Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by or crushed by hazards resulting from the collapse of the damaged industrial storage rack and/or the materials stored on them. On or about September 13, 2010, and at times prior thereto: Employees of Wal Mart store number 3870 were using a damaged industrial storage rack to store merchandise. The workers were exposed to stuck-by and/or crushed-by hazards from the damaged industrial storage rack and the stored merchandise. Among other methods, one feasible and acceptable method to abate this hazard is to inspect industrial storage racks and remove all damaged racks form service in accordance with ANSI MH16.1: 2008, Section 1.4.9 Rack Damage. Repairs to the damaged industrial storage rack must be approved by the rack manufacturer or qualified person.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by or crushed by the collapsing storage racks and/or the materials stored on them. On or about September 13, 2010, and at times prior thereto: Employees of Wal Mart store number 3870 were using industrial storage racks to store merchandise. The industrial storage racks were not equipped with signage indicating maximum permissible loads. The employees were exposed to struck-by and/or crushed-by hazards from the industrial storage racks and stored merchandise. Among other methods, one feasible and acceptable method to abate this hazard is to properly label each industrial storage rack with the maximum permissible load in accordance with ANSI MH16.1: 2008, Section 1.4.2 Plaque, which would include the use of plaques clearly indicating the maximum permissible loads for each industrial storage rack.
