Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by collapsing storage racks. On or about February 16, 2011, the storage rack systems used to store sheet metal, copper tubing, coils and other materials were not installed so as to prevent damage or collapse of the racks. Deficiencies included anchoring of the shelves and plaques indicating maximum load capacity. One feasible and acceptable method of abatement is to provide anchors that are capable of resisting sheer forces caused by horizontal and vertical loads and use of clearly visible plaques indicating maximum loading capacity as designated by the manufacturer or qualified person. The Rack Manufacturers Institute (RMI) Specification for the Design, Testing and Utilization of Industrial Storage Racks, MH16.1:2008, sections 1.4.2 and 1.4.7 provide specifications to abate this hazard.
