Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by or crushed by a tower crane. On or about July 1, 2011, and times prior thereto, outside in the yard behind the administrative office building, employees attempting to dismantle a TEREX/COMEDIL Self-Erecting Tower Crane, Model CBR 40H - 4, were exposed to being crushed due to the lack of the counter weight system which caused the tower crane to tip. Among other methods, one feasible and acceptable means of abatement to correct this would be to ensure that employees are adequately trained on how to safely erect tower cranes.
