North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a fall to a lower level: a)production area- on or about 10/15/09, one employee was standing on the elevated forks of a forklift without the use of an approved personnel lifting attachment equipped with standard guardrails and toe boards and properly secured. Among other methods, one feasible and acceptable abatement method to correct this hazard is the utilization of an approved personnel lifting attachment equipped with standard guardrails and toe boards that is properly secured to the forklift. Other methods could utilize other adequate methods such as ladders or scaffolding.
