North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall from height: a)jobsite-employees were riding the forks of the GEHL forklift, Model number RS5, Serial number RSJ5JUO711061, as materials were being raised to the top of the tubular framed scaffold approximately 33' above a hard solid surface. NOTE: Among other methods of abatement, one feasible and acceptable method to correct this hazard is to prohibit employees from riding the forks of a powered industrial truck.rial
