Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard being struck/hit by rigged up/hosted steel beams: Jobsite: The employer did not ensure through not only providing appropriate equipment and tools, but also observation, instruction and training that the employees, who were in the process of unloading and transporting steel beams from a flat-bed truck onto the ground were performing the task safely at all times. On or about 5/12/2010, two (2) employees were performing the above task only by utilizing a chain sling wrapped around steel beams to hoist and transport them from a flat-bed truck onto the ground, and one of steel beams slipped out of the sling and hit an employee who was in assisting the task. The employee sustained a severe leg laceration injury from the incident. Among other methods, one feasible and acceptable abatement methods to correct this hazard is to: 1. Utilize safe rigging and hoisting practices as specified in ASME B30.9-2006: SECTION 9- 1.10.4 Rigging Practices (j) When using multiple basket or choker hitches, the load should be rigged to prevent the sling from slipping or sliding along the load. 2. Utilize safe rigging and hoisting practices as specified in CFR 29 CFR 1910.184(c)(6): Slings shall be securely attached to their loads. 3. Provide proper and appropriate tools and equipment for the task. 4. Provide training and instruction. 5. Utilize other safe and effective means.
