Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by lightening when operating a 500 ton hydraulic crane during a lightening storm: Location: Jobsite, west end of power generation building, 1349 River Road, Middletown CT The employer was observed operating a 500 ton Leibherr hydraulic crane during an electrical storm in which cloud to ground lightening was actively occurring on the east side of the site. One feasible and acceptable method to correct this hazard would be to ensure that the crane is operated in accordance with the manufacturers latest publication which relates to safety precautions to be taken when working around electrical storms.cal
