Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire or explosion. a) On or about May 2, 2010, and in times prior thereto, at the Fincher Well # 1, Washington County, TX, the employer failed to protect employees from the hazards of fire and explosion at their work station on a catwalk by the mud tank. The employees were assigned to stand at the catwalk by the open top tank to observe the flow and cuttings and to manually empty the cuttings out of the screen where flammable vapors could ignite in the immediate area. Among other methods, feasible abatement includes controlling ignition sources and removing flammable vapors to safe locations in accordance with American Petroleum Institute (API) practices and equipment operating instructions.
