Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of falls:
(a)At the construction site where employer failed to ensure the proper use
of a scissor lift
by employee who was welding and cutting while standing on the mid rail of
the guard
railing system on a Genie 3426, exposing employee to the hazard of a 25
foot fall onto
a concrete floor.
"Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to comply with ANSI A92.6-1990 for Self-Propelled Elevating Work
Platforms: Section 8.10.1:
Personnel Footing: Personnel shall maintain a firm footing on platform
floor
while working
thereon. Use of planks, ladders, or any devices on the platform for
achieving additional height
or reach shall be prohibited".ed
