Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of been crush due to powered industrial truck tipover: a) An employee was operating a forklift to move HVAC equipment around the site. While moving this equipment, the driver was not wearing a seatbelt. The employee was operating this vehicle on unpaved rough terrain. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ASME/ANSI B56 1989 and ASME B56.1 1993, which requires that all forklift operators wear the provided seatbelt. In the Alternative: 9 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition, wherever it was necessary by reason of hazards of process or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: a) An employee was operating a forklift to move HVAC equipment around the site. While moving this equipment, the driver was not wearing a seatbelt. This vehicle/ forklift has ROP which requires the use of the seatbelt.
