Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazard of being struck by a tipping crane.
On or about September 24, 2010, the employer did not ensure that the
manufacturer's operating
instructions for the Link-Belt Hydraulic Truck Crane, Model HTC #8640,
were followed. (A)
The horizontal radius from the axis of rotation to the column that the
concrete was to be poured
was not determined prior to conducting lifting operations. (B) During
concrete bucket operations,
the load exceeded 80% of the rated lifting capacity. (C) The operator
relied on the MicroGuard
434 Rated Capacity Limiter, an operational aid that was set to
rigging/travel mode, to shut the
crane down when it reached the maximum capacity while lifting a 6100lb
concrete bucket.
Among other feasible and acceptable means of abatement one method of
abatement
would be to
follow the manufacturer's instructions in the Link Belt HTC-8640 operator
and crane rating
manuals.
