Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being struck by parts and tooling:
On or about October 6, 2010, in the repair shop, employee(s) were exposed
to a pulverizer
hydraulic cylinder support falling out of the chucks on the Bullard
vertical turret lathe.
Means of feasible abatement to correct this hazard include, but may not be
limited to:
A cylindrical shield made of stainless steel custom fitted and adjustable.
It should be strong
enough to prevent a heavy part from falling out or at least give the
operator time to escape the
danger zone. Comply with ANSI B11.6- 2001 Safety Requirements for Manual
Turning
Machines with or without Automatic Control; including but not limited to
Paragraph
6.21.1
Work Zones: "Work zones shall be guarded using fixed or movable guards to
prevent accidental
entry of body parts into the work zone and to contain processed materials,
fluids, parts and
tooling within the work zone."
In the alternative:
29 CFR 1910.212(a)(1): One or more methods of machine guarding was not
provided to protect
the operators and other employees in the machine area from hazards such as
those created by
point of operation, ingoing nip points, rotating parts, flying chips and
sparks.
On or about October 6, 2010, in the repair shop where an employee
operating the Bullard
vertical lathe had a pulverizer cylinder support fall out of the chucks,
exposing the employee to
being struck by the 1200 pound part. A shop made guard was not
substantially affixed and did
not properly enclose the rotating chucks.
